As one of my colleagues described to me, a lot of what personal injury lawyers do is build a “brick house” that defense attorneys cannot knock down. What I mean by that is, we have to build the case and evidence to make sure that the injured party is rightfully compensated at the end of the day. What people don’t realize is, just because there is an wreck or an injury, doesn’t mean you are automatically entitled to the rightful compensation that you should get. The wreck or injury is only a portion of injury lawyers have to prove to a judge or jury. After the incident has occurred, we have to prove what your damages are. That is one of the most important jobs of the plaintiff’s lawyer. You can be the best lawyer in the whole entire world; however, if the evidence of the case is damaged after the incident, no amount of lawyering is going to fix the damages.
Lately, I have seen a lot of potential clients who decided to not hire a lawyer and handle the case on their own thinking that the insurance company is going to take care of them. If that is the route that you decide to go, then by all means go fully through with that route. However, once you decide to go that route, there is no turning back. What I have lately found is potential clients thought they could handle it on their own and then later realize they can’t and decide to turn to a lawyer. What these people don’t realize is that while handling the case on their own, they have tainted and damaged a lot of the case and the evidence. As I have stressed, DON’T TRUST THE INSURANCE COMPANY. I have seen things from insurance companies telling their own customers to destroy evidence that could be used against them in court, all the way to insurance companies tricking the injured parties into damaging their case. The problem is, a lot of times when that person decides to hire a lawyer, it is way too late. The damages done to the case are beyond repair. I have seen it time and time again. There is a certain point where cases can’t be fixed and the evidence is beyond repair. Evidence is extremely crucial at the end of the day. If you don’t have the evidence, you don’t have a case. More importantly, if you have no evidence or the evidence is extremely damaged, the insurance company will not compensate you in any way.
I understand that people have a hard time trusting lawyers; therefore, they don’t want to involve lawyers in these wrecks and injuries. If that is what you want, then by all means handle the case on your own. However, you can’t expect a lawyer to fix the damages to the case after the fact. It is extremely difficult and almost impossible after the damage has been done. If you are injured and want the case handled right, I recommend contacting a lawyer RIGHT AWAY.
